近年來,平臺經濟迅速發展,創造了大量就業機會,依托互聯網平臺就業的網約配送員、網約車駕駛員、貨車司機等新就業形態勞動者數量大幅增加,維護勞動者勞動保障權益面臨新情況新問題。為解決這些問題,市總工會日前印發《關于維護新就業形態勞動者權益的若干措施》(以下簡稱《若干措施》),從建會入會、法律維權、貼心服務等領域對維護青島市靈活就業“八大群體”和新就業形態勞動者的權益作出具體規定。

  《若干(gan)措施(shi)》中明確指出,要(yao)通過豐富建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)渠(qu)道、創新(xin)和簡化入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)流程(cheng)、傾斜資源(yuan)力量(liang)促進建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)等(deng)方(fang)式(shi)加快推進新(xin)就業(ye)形(xing)(xing)態勞動者(zhe)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)。針(zhen)對新(xin)就業(ye)形(xing)(xing)態勞動者(zhe)的職業(ye)特點,要(yao)探索不同形(xing)(xing)式(shi)的建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)形(xing)(xing)式(shi),在全市組織開展新(xin)就業(ye)形(xing)(xing)態領(ling)域(yu)(yu)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)集中行(xing)(xing)動。要(yao)摸清(qing)新(xin)就業(ye)形(xing)(xing)態領(ling)域(yu)(yu)勞動者(zhe)基本情況(kuang)和工(gong)會(hui)(hui)(hui)(hui)(hui)組織建(jian)(jian)(jian)(jian)設情況(kuang),建(jian)(jian)(jian)(jian)立工(gong)作臺(tai)賬,通過單獨(du)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)、聯合建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)、行(xing)(xing)業(ye)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)、區域(yu)(yu)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)等(deng)多(duo)種方(fang)式(shi)建(jian)(jian)(jian)(jian)會(hui)(hui)(hui)(hui)(hui)。依托平臺(tai)企業(ye)工(gong)會(hui)(hui)(hui)(hui)(hui)、行(xing)(xing)業(ye)工(gong)會(hui)(hui)(hui)(hui)(hui)、社區(園區、樓宇)工(gong)會(hui)(hui)(hui)(hui)(hui)聯合會(hui)(hui)(hui)(hui)(hui)等(deng)基層工(gong)會(hui)(hui)(hui)(hui)(hui)組織,廣泛(fan)吸收新(xin)就業(ye)形(xing)(xing)態勞動者(zhe)加入(ru)(ru)工(gong)會(hui)(hui)(hui)(hui)(hui)。依托智慧工(gong)會(hui)(hui)(hui)(hui)(hui)平臺(tai),建(jian)(jian)(jian)(jian)設“網(wang)上(shang)職工(gong)之家(jia)”,開通網(wang)上(shang)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui)渠(qu)道,吸引新(xin)就業(ye)形(xing)(xing)態勞動者(zhe)實現網(wang)上(shang)入(ru)(ru)會(hui)(hui)(hui)(hui)(hui),并分類(lei)建(jian)(jian)(jian)(jian)立新(xin)就業(ye)形(xing)(xing)態勞動者(zhe)會(hui)(hui)(hui)(hui)(hui)員數據庫。

  《若(ruo)干(gan)措施》提出,要(yao)加(jia)大(da)專項經(jing)(jing)(jing)費(fei)(fei)(fei)保(bao)障(zhang),按照市總(zong)工(gong)會(hui)(hui)和(he)區市總(zong)工(gong)會(hui)(hui)各負(fu)擔50%的原則建(jian)立基(ji)層工(gong)會(hui)(hui)建(jian)設(she)專項經(jing)(jing)(jing)費(fei)(fei)(fei)制(zhi)度,根據新(xin)就業(ye)形(xing)態勞動者新(xin)入會(hui)(hui)人數分別(bie)給予2000元和(he)5000元專項經(jing)(jing)(jing)費(fei)(fei)(fei);建(jian)立以實績為主導(dao)的差異(yi)性補貼機制(zhi),根據新(xin)就業(ye)形(xing)態工(gong)會(hui)(hui)聯合(he)會(hui)(hui)所(suo)轄單建(jian)(聯合(he))工(gong)會(hui)(hui)數、職(zhi)工(gong)(會(hui)(hui)員(yuan))數、規模及工(gong)作情況,每(mei)(mei)家每(mei)(mei)年分別(bie)補助5000元、10000元、20000元工(gong)作經(jing)(jing)(jing)費(fei)(fei)(fei)。

  為(wei)強化新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)勞(lao)動者的(de)(de)權(quan)益(yi)保(bao)(bao)障(zhang)(zhang)(zhang),《若干措施》對勞(lao)動者參(can)加工(gong)(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)互(hu)助(zhu)保(bao)(bao)障(zhang)(zhang)(zhang)、關愛新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)女(nv)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)等做(zuo)了(le)明確要求。其(qi)中(zhong),面(mian)向參(can)加城(cheng)鎮職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)基本醫(yi)(yi)療保(bao)(bao)險(xian)(xian)或城(cheng)鄉居民基本醫(yi)(yi)療保(bao)(bao)險(xian)(xian)并加入工(gong)(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)組(zu)織的(de)(de)新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)勞(lao)動者,市總(zong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)贈送(song)一(yi)年(nian)保(bao)(bao)障(zhang)(zhang)(zhang)期的(de)(de)重(zhong)大疾(ji)病、意(yi)外傷害互(hu)助(zhu)保(bao)(bao)障(zhang)(zhang)(zhang)計劃。鼓(gu)勵新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)勞(lao)動者參(can)加醫(yi)(yi)療互(hu)助(zhu)保(bao)(bao)障(zhang)(zhang)(zhang)計劃,由(you)市總(zong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)給予補助(zhu),提高(gao)他們抵(di)御(yu)風險(xian)(xian)的(de)(de)能力(li)。全(quan)(quan)市工(gong)(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)將及時指(zhi)導建(jian)立(li)(li)健(jian)全(quan)(quan)新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)領(ling)域基層工(gong)(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)女(nv)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)組(zu)織,指(zhi)導簽訂女(nv)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)特殊(shu)權(quan)益(yi)專(zhuan)項集體合(he)同(tong),保(bao)(bao)障(zhang)(zhang)(zhang)女(nv)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)的(de)(de)合(he)法權(quan)益(yi)和特殊(shu)利益(yi);免費為(wei)2000名35—59周歲新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)領(ling)域女(nv)會(hui)(hui)員提供 “兩癌”(乳腺(xian)癌、宮(gong)頸癌)篩查(cha),并贈送(song)“女(nv)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)特殊(shu)疾(ji)病保(bao)(bao)障(zhang)(zhang)(zhang)”。全(quan)(quan)市工(gong)(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)將以出(chu)行(xing)(xing)、外賣、即時配送(song)、同(tong)城(cheng)貨運等行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)的(de)(de)平(ping)臺企業(ye)(ye)(ye)(ye)(ye)為(wei)重(zhong)點,深入開展 “安(an)康杯(bei)”和“查(cha)保(bao)(bao)促”群眾性安(an)全(quan)(quan)生產活動,督導相關企業(ye)(ye)(ye)(ye)(ye)建(jian)立(li)(li)健(jian)全(quan)(quan)新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷預防機制,推進工(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷預防、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷補償、工(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷康復(fu)相結合(he)的(de)(de)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)傷保(bao)(bao)險(xian)(xian)制度,提升新(xin)(xin)(xin)就(jiu)(jiu)業(ye)(ye)(ye)(ye)(ye)形態(tai)勞(lao)動者保(bao)(bao)障(zhang)(zhang)(zhang)水平(ping)。

《若干措(cuo)施》倡(chang)導(dao)強(qiang)化法(fa)(fa)(fa)(fa)律(lv)維權服(fu)務,推動(dong)(dong)健(jian)全勞(lao)動(dong)(dong)保障(zhang)法(fa)(fa)(fa)(fa)律(lv)制度,加大(da)工會(hui)(hui)(hui)法(fa)(fa)(fa)(fa)律(lv)的(de)援(yuan)助力度,強(qiang)化新就業(ye)形態(tai)領域(yu)普法(fa)(fa)(fa)(fa)宣傳,通過(guo)扎(zha)實有效的(de)維權服(fu)務,最大(da)限度地把新就業(ye)形態(tai)勞(lao)動(dong)(dong)者吸引過(guo)來(lai)、組織起來(lai)、穩固下來(lai)。開展(zhan)“勞(lao)動(dong)(dong)用工法(fa)(fa)(fa)(fa)治體(ti)檢(jian)”,由市及(ji)區市總(zong)工會(hui)(hui)(hui)統一安(an)排,組建(jian)專業(ye)法(fa)(fa)(fa)(fa)律(lv)隊伍,免費對平臺企(qi)(qi)業(ye)進行風險(xian)點評估,即(ji)為(wei)(wei)企(qi)(qi)業(ye)開展(zhan)一次法(fa)(fa)(fa)(fa)律(lv)風險(xian)“體(ti)檢(jian)”,為(wei)(wei)企(qi)(qi)業(ye)經營管理人員和(he)(he)職工開展(zhan)一次法(fa)(fa)(fa)(fa)律(lv)講座,為(wei)(wei)企(qi)(qi)業(ye)提供一次法(fa)(fa)(fa)(fa)律(lv)和(he)(he)決策咨(zi)詢,為(wei)(wei)企(qi)(qi)業(ye)制定(ding)一個(ge)防范(fan)和(he)(he)避免法(fa)(fa)(fa)(fa)律(lv)風險(xian)的(de)“法(fa)(fa)(fa)(fa)律(lv)處方”,指導(dao)企(qi)(qi)業(ye)工會(hui)(hui)(hui)調處一批勞(lao)動(dong)(dong)爭議(yi)案件,協(xie)助企(qi)(qi)業(ye)工會(hui)(hui)(hui)開展(zhan)一次職工隊伍穩定(ding)隱患排查。通過(guo)“勞(lao)動(dong)(dong)用工法(fa)(fa)(fa)(fa)治體(ti)檢(jian)”,從根本上規范(fan)平臺企(qi)(qi)業(ye)用工,使(shi)維權關(guan)口前移。

  為給(gei)新(xin)(xin)(xin)就業形態(tai)勞(lao)動者(zhe)提(ti)供優質貼心(xin)服務(wu),《若(ruo)干(gan)措(cuo)施》還提(ti)出(chu)要(yao)完成年內新(xin)(xin)(xin)增100個服務(wu)新(xin)(xin)(xin)就業形態(tai)勞(lao)動者(zhe)愛(ai)心(xin)服務(wu)陣地(di)的(de)任務(wu),同時要(yao)發(fa)揮好(hao)新(xin)(xin)(xin)時代共(gong)享區(qu)域(yu)職(zhi)工之(zhi)(zhi)家、職(zhi)工信賴(lai)的(de)職(zhi)工之(zhi)(zhi)家、戶外勞(lao)動者(zhe)驛站、心(xin)理(li)健(jian)康(kang)服務(wu)站點和愛(ai)心(xin)媽(ma)媽(ma)小屋等(deng)愛(ai)心(xin)服務(wu)陣地(di)作用,讓新(xin)(xin)(xin)就業形態(tai)勞(lao)動者(zhe)體會到“家”的(de)溫馨(xin)。
